1. Acceptance of Terms

By accessing or using the website located at findtenders.in ("Website"), operated by FindTenders ("Company", "we", "us", or "our"), you ("User", "you", or "your") agree to be bound by these Terms of Service ("Terms"). If you do not agree, you must not access or use the Website.

2. Nature of the Service

FindTenders is an information aggregator. We collect, compile and display tender notices published on public government e-procurement portals (such as the Central Public Procurement Portal, state e-procurement portals and the Government e-Marketplace) and other public records.

  • We do not invite, receive or evaluate bids. Bids are submitted only on the official portal.
  • We do not act as brokers, agents, intermediaries, or advisors.
  • We do not facilitate or participate in any procurement or contract.
  • We have no relationship with any government department, public sector undertaking or other buyer whose tenders appear on the Website, and we are not a government website.

3. No Warranty & Disclaimer of Accuracy

While we take utmost care to maintain data to the highest standards possible, all information on the Website — including but not limited to tender titles and descriptions, estimated values, EMD and tender fee amounts, bid submission and opening dates, locations, organisations, eligibility read from tender documents, classifications and any analytical or derived data — is provided on a "AS IS" and "AS AVAILABLE" basis, without warranty of any kind, whether express, implied, statutory, or otherwise.

We expressly disclaim all warranties including, without limitation, warranties of merchantability, fitness for a particular purpose, accuracy, completeness, timeliness, reliability, and non-infringement.

Tender data is compiled from publicly available sources using automated processes. Although we employ rigorous quality checks and cross-validation to ensure the highest possible accuracy, automated data compilation is inherently susceptible to errors. We do not guarantee the accuracy, correctness, or completeness of any tender data. Errors may include but are not limited to incorrect values or EMD amounts, wrong bid deadlines, missed corrigenda, inaccurate descriptions, misidentified locations, and incorrect organisation details.

You must independently verify all information in the tender documents on the official portal, and with the tender inviting authority, before taking any action whatsoever.

4. Limitation of Liability

To the maximum extent permitted by applicable law, the Company, its directors, officers, employees, affiliates, agents, contractors, and licensors shall not be liable for any direct, indirect, incidental, special, consequential, punitive, or exemplary damages, including but not limited to:

  • Loss of profits, revenue, data, goodwill, or business opportunities;
  • Financial loss arising from reliance on tender data;
  • Damages arising from incorrect, incomplete, outdated, or misleading information displayed on the Website;
  • Damages arising from decisions made based on values, deadlines, eligibility, classifications, alerts or reminders (including a missed or late alert or reminder), or any other data on the Website;
  • Loss or damage of any kind arising from participation, or non-participation, in any tender or contract;
  • Any damages arising from unauthorized access to or alteration of your data or transmissions;
  • Any other matter relating to the Website or its content;

— whether based on warranty, contract, tort (including negligence), strict liability, or any other legal theory, and whether or not the Company has been advised of the possibility of such damages.

In no event shall our total cumulative liability to you for all claims exceed the amount you have paid to the Company in the twelve (12) months immediately preceding the event giving rise to the claim, or INR 1,000 (Indian Rupees One Thousand), whichever is lower.

5. Indemnification

You agree to indemnify, defend, and hold harmless the Company, its directors, officers, employees, affiliates, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or related to:

  • Your use of or reliance on the Website or its content;
  • Your violation of these Terms;
  • Any bid you submit or contract you enter into based on information from the Website;
  • Your violation of any applicable law or regulation.

6. User Accounts

Certain features require registration. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You must provide accurate information and promptly update it if it changes. We reserve the right to suspend or terminate accounts at our sole discretion without notice.

7. Paid Subscriptions & Payments

Premium features are available via paid subscription plans. Subscription fees are non-refundable except as stated in our Refund Policy. We reserve the right to modify pricing at any time. Continued use after a price change constitutes acceptance of the new pricing.

8. Intellectual Property

All content on the Website — including design, layout, text, graphics, logos, software, and derived analytics — is the property of the Company or its licensors and is protected by intellectual property laws. You may not reproduce, distribute, modify, create derivative works from, publicly display, or exploit any content without our prior written consent.

Tender notices and documents sourced from public portals remain the property of the respective publishers. Our compilation, structuring, and presentation of such data constitutes our proprietary work.

9. Prohibited Conduct & Anti-Scraping Policy

The following activities are strictly prohibited for all users, including paid subscribers. A paid subscription grants you a personal, non-transferable, limited licence to view and use data through the Website interface only — it does not grant any right to bulk-extract, download, or redistribute data in any form.

  • Scraping, crawling, spidering, or any form of automated data extraction from the Website, whether using bots, scripts, browser extensions, APIs, or any other automated means;
  • Systematic or bulk downloading, copying, or saving of tenders, documents, or any other Website content;
  • Using any tool, software, or technique to bypass rate limits, access controls, CAPTCHAs, or other anti-scraping measures;
  • Reselling, sublicensing, republishing, or redistributing Website content — whether in original or modified form — to any third party, competing service, or data aggregation platform;
  • Building or populating any database, dataset, directory, or catalogue using data obtained from the Website;
  • Sharing, transferring, or providing account credentials to third parties to enable any of the above activities;
  • Attempting to gain unauthorized access to any part of the Website, its servers, databases, or APIs;
  • Using the Website for any unlawful purpose or in violation of any applicable law;
  • Interfering with or disrupting the Website or its infrastructure.

Consequences: Violation of this policy will result in immediate termination of your account (including paid subscriptions) without refund, permanent ban from the Website, and may result in legal action including claims for damages, injunctive relief, and recovery of legal costs. We actively monitor for automated access patterns and reserve the right to block any user, IP address, or device at our sole discretion.

10. Third-Party Links & Services

The Website may contain links to third-party websites or services. We do not endorse, control, or assume responsibility for any third-party content or services. Your interaction with third parties is solely between you and them.

11. Modification of Terms

We reserve the right to modify these Terms at any time. Changes will be effective upon posting on the Website. Your continued use of the Website after changes are posted constitutes acceptance of the revised Terms. We encourage you to review this page periodically.

12. Termination

We may terminate or suspend your access to the Website at any time, without prior notice or liability, for any reason including breach of these Terms. Upon termination, your right to use the Website ceases immediately.

13. Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts in Hyderabad, Telangana, India.

14. Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
